Northern District of Alabama Dismisses Lanham Act Suit Over YouTube Video
The Northern District of Alabama recently ruled in favor of Dennis and Evans Bailey’s client when it dismissed a Lanham Act claim over a video posted to YouTube. Judge Liles Burke of the Northern District of Alabama found that the content of the video, which discussed crawl space treatment products, was not commercial speech subject to the Lanham Act.
