Mr. McBride joined the firm as an associate in May 2000 and became a shareholder in 2007. He practices in corporate and business law, taxation, healthcare law, election law, and estate planning and probate. His primary practice involves advising corporations, limited liability companies, and other entities with general business needs.

Mr. McBride represents a wide variety of general businesses, providing advice on matters such as organizational design, operations, contracting, tax planning, and business changes. Additionally, he represents a number of trade associations and other nonprofit organizations, to whom he provides specialized advice on matters such as nonprofit status, tax exemption, and corporate compliance. Mr. McBride also has experience representing and assisting physicians, physical therapists, and other health care practitioners with matters concerning regulatory compliance and the structuring of healthcare arrangements/ventures.

Mr. McBride has experience with election law issues and political action committee formation and operation. He also assists individuals with general estate planning and probate advice, and he regularly represents clients in all types of federal, state, and local tax matters. 

Recent Practice Highlights

Represented a regional automobile dealer in the purchase of a large automobile dealership from a United States auto manufacturer.

Represented several physician groups in the negotiation and consummation of contracts with other physician groups for the provision of specialized healthcare services in compliance with the federal Stark and Anti-Kickback laws.

Represented physical therapy practice in the negotiation of several contracts with hospitals and physician groups for the provision of in-house physical therapy services.

Represented several clients in sales and use tax and utility tax cases before the Alabama Department of Revenue as well as before several counties and municipalities.

Represented individual client in a “responsible person” federal payroll tax case before the Internal Revenue Service.

Serves as general counsel to PT Solutions, a large, multi-state physical therapy practice.

Represented a medical trade association in an “unrelated business income tax” (UBIT) matter before the Internal Revenue Service.

Represented a physician group in the structuring and consummation of an MRI venture in south Alabama satisfying the “rural health care exception” under the federal Stark and Anti-Kickback laws.

Assisted a trade association with the design and formation of an Alabama political action committee to be used to support certain legislative and political initiatives.

Presentations

Mr. McBride is often asked to speak to boards and at client meetings on various topics. He has also spoken at several seminars on such topics as the Alabama income tax, Alabama sales and use tax, and general estate planning needs.

Honors and Awards

Mr. McBride served as temporary probate judge for Montgomery County at the request of the Honorable Reese McKinney, Jr.

Community Involvement

Mr. McBride is a member of the First United Methodist Church in Montgomery. He serves on the board of directors and as alumni council president for The Montgomery Academy. Mr. McBride is also a member of the board of directors for Montgomery Boys and Girls Club, and coaches T-Ball for the Southeastern Baseball League, Buddy Watson Park.
